“Triple Play:” MA Hams Receive Amateur Radio Proclamations, Resolutions from House, Senate, and Governor

MA State HouseMassachusetts ARRL staff received copies of proclamations and resolutions congratulating the Amateur Radio community for its service to the Commonwealth, and for the upcoming annual Field Day exercise June 22-23, 2019. 

The Massachusetts House of Representatives document “offers its sincerest congratulations to the American Radio Relay League in recognition of The ARRL Field Day and the Tireless Work of Amateur Radio Operators.” The document was signed by Robert A. DeLeo, Speaker of the House.

The Massachusetts State Senate weighed in with a resolution, adopted May 9, 2019. “[The Senate] extends its appreciation to Amateur Radio operators as they celebrate Amateur Radio Week and Field Day.” The resolution was signed by Senate President Karen E. Spilka and Michael D. Hurley, Senate Clerk. It was offered by Senator Bruce E. Tarr (N1UIU), who represents the 1st Essex and Middlesex District.

The Governor’s Office issued a proclamation proclaiming June 22, 2019 to be “Amateur Radio Day” in the Commonwealth. The proclamation was signed by His Excellency Charles D. Baker, Governor of the Commonwealth, Karyn E. Polito, Lt. Governor of the Commonwealth, and William Francis Galvin, Secretary of the Commonwealth.

MA State Government Liaison Hank McCarl, W4RIG, was instrumental in securing the three documents.

Copies of the documents will be delivered to Tom Walsh, K1TW, and Ray Lajoie, KB1LRL, ARRL Section Managers for Eastern and Western Massachusetts, respectively; and to ARRL New England Division Director Fred Hopengarten, K1VR.  K1TW plans to bring the copies with him for display as he tours various Field Day sites around the section.

 

Driver Hand-Held Cellphone Ban Moves Closer To Becoming Law

BOSTON (AP), June 6 — A bill that would bar Massachusetts drivers from using hand-held cellphones behind the wheel has moved one step closer to becoming law.

The Massachusetts Senate on Thursday voted unanimously to approve the bill that would also ramp up the collection of data on traffic stops around the state, after concerns were raised by minority legislators that a cellphone law could lead to more racial profiling.

Massachusetts Hands-free Mobile Device Legislation Update

MA State HouseHands-free mobile device legislation moved one step closer to becoming law, passing in the Massachusetts House on May 16. But by all accounts Amateur Radio operation while driving will remain unaffected.

Eastern Massachusetts section staff who have been in touch with legislative aides in both the House and Senate have learned the language that defines mobile devices will continue to exempt “federally-licensed 2-way radios.”

“MGL Chapter 90 Section 13 provides for the use of a federally licensed 2-way radio while driving. The hands-free bill being considered (House Bill 3793) does not alter this provision,” according to a staffer in Rep. Ferrante’s office. Another staffer from Rep. Hecht’s office also confirmed the preservation of the existing language in Chapter 90 Section 13 pertaining to federally licensed 2-way radios.

FCC Takes a New Tact in Combatting Unlicensed Radio Broadcasting

In what may be a first in the effort to crack down on unlicensed broadcasters, the United States has filed a civil action to stop a church-related pirate radio station from operating in Worcester, Massachusetts. The Massachusetts US Attorney’s Office is seeking an injunction to shut down the station, operating on 97.1 MHz.

“This groundbreaking step, for an injunction to stop a pirate radio operator’s illegal activities, is part of our continued efforts to combat illegal broadcasting,” FCC Enforcement Bureau Chief Rosemary Harold said this week. “As we work with our law enforcement colleagues to use every tool in our toolbox to combat pirate radio, I welcome the Justice Department’s renewed use of its Section 401(a) injunction authority. Along with fines, equipment seizures, and warnings, this action underlines our continued interest in combatting this serious problem.”

The FCC already has fined operator Vasco Oburoni and Christian Praise International Church $15,000 for repeated violations of its rules against unlicensed operation. The complaint recounts that Oburoni and the church first began operating an unlicensed station in Worcester on 102.3 MHz. After issuing multiple warnings, the FCC levied the $15,000 penalty, and Oburoni agreed to a payment plan. But later, he began broadcasting again, this time on 97.1 MHz. At least one licensed broadcaster has complained to the FCC, citing interference concerns.

Mike will discuss the ARRL Board of Directors meeting; Tom will describe the proposed hands-free cell bill now in the Massachusetts Legislature. Proposed MA Legislation Seeks to Require “Hands-free” Cell Phone Use While Driving

MA State HouseMassachusetts Governor Charlie Baker on Tuesday “proposed his most sweeping set of road safety rules yet, calling for Massachusetts to join 16 other states in requiring hands-free cell phone use while driving and proposing to allow police to stop motorists for not wearing a seat belt,” according to Boston’s PBS station, WGBH.

Various pieces of “hands-free” cell phone legislation have been introduced in recent years by members of the State House and Senate and while some have included clear exemptions for Amateur Radio operators, others have been vague or non-existent on the matter.

State Government Liaison Hank McCarl, W4RIG, quickly alerted ARRL section and division leadership about the proposed legislation. 

McCarl reports he has already spoken with his State Senator’s office legislative assistant about the ARRL’s concerns regarding the wording of proposed legislation on hand held cell phones while driving. They “will keep a close eye on the wording of that legislation and let us know if there seems to be any problems for our mobile operations as licensed amateurs in community service or training,” McCarl said.

ARRL Headquarters Regulatory Information Manager Dan Henderson, N1NC was also notified of the proposed legislation by Section Manager Tom Walsh, K1TW.

Massachusetts House Passes Resolution Proclaiming Amateur Radio Week

MA House sealA resolution has been passed in the Massachusetts State House honoring Amateur Radio operators and proclaiming an “Amateur Radio Week” to coincide with Field Day. The resolution was introduced by Rep. Jonathan Hecht, who represents the 29th Middlesex District (Cambridge, Watertown).  It was signed on June 18, 2018 by Hecht, along with House Speaker Robert A. De Leo and House Clerk Steven T. James.

The language of the House bill is identical to the text in the counterpart Senate resolution. Copies of the resolution have been mailed to ARRL Eastern and Western MA Section Managers Tom Walsh, K1TW and Ray Lajoie, KB1LRL and should arrive in time for this weekend’s Field Day.

Massachusetts Senate Proclaims Amateur Radio Week

Massachusetts State Senate sealA Resolution has been received by the ARRL Eastern and Western MA Section Managers from Harriette L. Chandler (D-Worcester), President of the Massachusetts State Senate.  The Resolution, adopted on June 4, 2018, is entitled “Commemorating Amateur Radio Week and Honoring Amateur Radio  Operators as They Celebrate Field Day”:

 

WHEREAS,  Amateur Radio operators have made great contributions in developing world-wide radio communications; and

 

WHEREAS, over 13,500 Amateur Radio operators thrive in the Commonwealth, consistently displaying their value in public assistance; and

 

WHEREAS, Amateur Radio operators use their equipment and skills to unfailingly assist local and state officials in cases of tornadoes, floods, hurricanes, and other emergencies; and

 

WHEREAS,  Amateur Radio operators in the Commonwealth have generously volunteered their time, equipment and knowledge to provide communications, support and technical training to local service clubs, organizations and interested citizens; and

 

WHEREAS, on June 23 and 24, Amateur Radio operators in the Commonwealth will join with other operators from around the country to participate in Field Day, a 24-hour simulated emergency highlighting Amateur Radio operators’ emergency response capabilities; now therefore be it

 

RESOLVED, that the Massachusetts Senate extends its appreciation to Amateur Radio operators as they celebrate  Amateur Radio Week and Field Day; and be it further

 

RESOLVED, that a copy of these resolutions be transmitted forthwith by the Clerk of the Senate to the Western and Eastern Massachusetts sections of the American Radio Relay League, the National Association for Amateur Radio.

 

MA Governor, Senate & House Issue Amateur Radio Proclamations

Proclamations have been sent to ARRL Eastern and Western MA Section Managers from the Massachusetts Governor’s Office, the State House of Representatives, and the MA Senate, respectively. These proclamations coincide with the annual ARRL Field Day event on June 24-25, 2017.

The proclamation from the Governor of the Commonwealth of Massachusetts declares June 24th, 2017 to be Amateur Radio Day:

“WHERE AS, The Commonwealth of Massachusetts has approximately 14,000 amateur radio operators, who continually demonstrate their value in public assistance;”

Commonwealth of Massachusetts Honors Amateur Radio, ARRL

2014 Gubernatorial Amateur Radio Proclamation[UPDATE: On June 28, the Massachusetts House of Representatives passed a Citation recognizing ARRL’s anniversary. The text is included at the end of this story.]

The Executive and Senate branches of the Commonwealth of Massachusetts have recognized Amateur Radio and the ARRL with a Gubernatorial Proclamation and Senate Resolution, respectively. The Governor recognized an “Amateur Radio Day” while the Senate resolved to “join in celebration of the 100th anniversary of the American Radio Relay League.”

Eastern Massachusetts Section Manager Phil Temples, K9HI accepted the documents today from Senate Minority Leader Bruce E. Tarr (R-Gloucester) at his State House office. Separate copies of the documents are being mailed to Ed Emco, W1KT, the ARRL Section Manager of Western Massachusetts. Also assisting with the project was newly appointed State Government Liaison Hank Mc Carl, W4RIG, of Gloucester.

Temples will tour various Field Day sites on June 28-29 to show the proclamation and resolutions to ARRL clubs and groups participating in the annual exercise. Tarr, who is also a licensed ham, plans to tour several Field Day sites in his district with copies of the documents as well.

K3HI Steps Down as State Government Liaison

Shawn O’Donnell, K3HI, Framingham, has resigned as the State Government Liaison for Massachusetts.

“My current schedule does not allow me to contribute as SGL as much as I had been able to in the past. It is time for me to resign as SGL,” writes K3HI. “It’s been a good ride. A couple of quashed bills here and there, a couple of proclamations now and then, assisting Tom Carrigan, NE1R to get PRB-1 into Massachusetts law, and then helping a number of hams with the legal citation for their zoning boards,” he adds.

Eastern MA ARRL Section Manager Phil Temples, K9HI praised O’Donnell’s efforts in his SGL role over the past several decades. “It’s been a tremendous experience to work with someone as dedicated as Shawn. He’s performed a superb job of keeping his finger on the pulse of Beacon Hill, and warning the amateur community of potential legislation that might have an adverse impact on our hobby service.”

“It’s time for some new blood and excitement in the role,” added O’Donnell. “I greatly appreciate the opportunity to work with all of you. Please pass along my 73.”

Ipswich EMA To Conduct First Field Day Operation

2012 ARRL Field Day logo A new Field Day effort conducted by the Ipswich Emergency Management Agency will debut in Ipswich this weekend, according to EMA Director Jon Hubbard, W1HUB.

The group is off to a great start in the public relations department: they secured an official proclamation in conjunction with Field Day from the Town’s Board of Selectmen at a June 11 meeting. The presentation can be viewed at http://ipswichma.granicus.com/MediaPlayer.php?view_id=2&clip_id=244.

“This year will be [our] first attempt at field day operating as W1IEM. We will be operating on Saturday, June 23 from 2-6PM and maybe a little longer depending on interest levels.”

Sen. Bruce Tarr Visits Cape Ann ARA

Bruce Tarr visit to CAARA, July 17, 2011The Cape Ann Amateur Radio Association hosted Massachusetts State Senator Bruce Tarr, N1UIU along with Eastern MA ARRL leaders at its club house in Gloucester on Sunday, July 17. Tarr brought along the original Senate-House Resolution proclaiming Amateur Radio Week in Massachusetts. His office was instrumental in helping the Eastern MA ARRL field organization to secure both the legislative resolution as well as a gubernatorial proclamation.

Sen. Tarr described the steps involved in creating the resolution and its impact–particularly, how it underscores the work of amateur radio operators in the Commonwealth. He praised CAARA and its members for their dedication to public service, as well as acknowledging the club’s ARRL Special Service Club status.

Marlborough Proclaims “Amateur Radio Week”

City of Marlborough 2011 Amateur Radio Week ProclamationThe City of Marlborough has recognized the efforts of its more than 140 licensed Amateur Radio operators “who have demonstrated their value in public assistance” with a special proclamation coinciding with Field Day.

The Proclamation, signed by Nancy E. Stevens, Mayor of Marlborough, recognizes ARRL Field Day and proclaims June 26-July 2, 2011 as “Amateur Radio Week.”

The document was on display at the Algonquin Amateur Radio Club‘s Field Day operation conducted from the City’s Emergency Operations Center.

 

 

 

 

 

 

 

 

 

 

MA Senate Passes Amateur Radio Week Declaration

2011 MA Senate Resolution honoring Amateur Radio WeekIn conjuntion with ARRL Field Day, the Massachusetts State Senate passed a Resolultion late last week “honoring Amateur Radio operators as they celebrate Amateur Radio Week and participate in Field Day.”

Like the Governor’s Proclamation, the Senate Resolution was brought about through the efforts of State Government Liaison, K3HI, Local Government Liaison Hank McCarl, W4RIG, by several club presidents; and, by one licensed Amateur in particular who happens to be a Massachusetts State Senator: Bruce Tarr, N1UIU.

Although a copy was not available to tour during Field Day, hard copies of the Resolution have been transmitted to ARRL Headquarters, and to Eastern and Western MA Section Managers Phil Temples, K9HI and Ed Emco, W1KT, respectively.

Governor Proclaims “Amateur Radio Week” in Massachusetts!

MA Amateur Radio Week 2011 ProclamationJust in time for Field Day–Massachusetts Governor Deval L. Patrick has declared June 25-26, 2011 to be “Amateur Radio Week” in Massachusetts.

The Proclamation was signed at the Executive Chamber in Boston on June 15. The official document was awarded on June 21 to ARRL Eastern Massachusetts Section Manager Phil Temples, K9HI who met wtih Bianca Hoffman in the Governor’s Office on Beacon Hill. Last year’s proclamation was secured through the diligent efforts of the Hampden County Radio Association in Western Massachusetts. (See <http://ema.arrl.org/node/1712>.)

Several individuals worked to secure this year’s proclamation, according to Temples. “I want to acknowledge the work of our State Government Liaison, K3HI, along with effort by several club presidents–and in particular, one of our Local Government Liaisons, Hank McCarl, W4RIG of Gloucester,” remarked Temples. “Hank set up conversations with the office of the Senate Minority Leader–who is, coincidentally, a licensed amateur, and a member of the Cape Ann Amateur Radio Association.” Temples added, “We hope also to secure a Senate Resolution honoring Amateur Radio before the start of Field Day.”

K9HI plans to tour with the official Proclamation throughout Eastern Massachusetts during the Field Day weekend.

Texting Bill Legislation Update from State Government Liaison K3HI

The bill doesn’t look exactly like I thought it would, given the Senate amendments, but it looks OK. Here’s the important part, in the updated definitions section of Chapter 90:

“Mobile telephone”, a handheld or portable cellular, analog, wireless, satellite or digital telephone, including a telephone with 2-way radio functionality, capable of sending or receiving telephone communications and with which a user initiates, terminates or engages in a call using at least 1 hand. For the purposes of this chapter, “mobile telephone” shall not include amateur radios operated by those licensed by the Federal Communications Commission to operate such radios, or citizen band radios.

This bill doesn’t have a hands-free mobile phone requirement. If they ever enact one, we’ll be exempt.

Can you use APRS/messaging systems while driving? The prohibition on texting while driving reads:

No operator of a motor vehicle shall use a mobile telephone, or any handheld device capable of accessing the internet, to manually compose, send or read an electronic message while operating a motor vehicle.

The definition section says ham radios aren’t mobile telephones, so you’re OK there. But there are connections between APRS systems and the Internet. So let’s give two arguments why you shouldn’t use APRS systems while driving: (a) it’s dangerous, and (b) you’d probably lose the argument about your device not being able to access the Internet. The bottom line: even if the particular message you’re reading/sending isn’t going out on the internet, the prohibition applies to you.

The governor was supposed to sign the bill [July 2] at noon.The bill becomes law at the end of September.
